Defendant 17 and 19 – father of a family deceased: trial against disco thieves

They still look like two boys. But since Tuesday they have been facing serious charges at the Eisenstadt Regional Court. A now 17-year-old from Bad Sauerbrunn and a 19-year-old Syrian beat family father Jürgen T. in an argument shortly before Christmas 2022 after a visit to a disco in Schattendorf. The Schattendorfer later died in hospital. Prosecutors say an aneurysm burst and the blow was not the confirmed cause. The victim was extremely drunk on the night of the crime.

Unusual start of the process
Ahmed N. (19) politely opened the door of room 1 of the Eisenstadt Regional Court on Tuesday. Anyone who said ‘thank you’ upon entering was greeted with a ‘you’re welcome’. The Syrian then took his place in the dock and admitted his full guilt. Yes, he hit Jürgen T. (42) on the night of December 18, 2022, “with his half-open fist because he had hit me beforehand.”

And yes, when he wanted to leave, he hit T’s friend Gerald B. (42) twice in the face with his fist because he attacked me. B. suffered a broken nose and eye socket. T., father of two children, never woke up from his coma.

“I have nothing to do with it”
Gerhard B. (17), the second suspect, is said to have hit T. on the back of the head with a brass knuckle almost simultaneously with the Syrian in front of the disco. This was confirmed by several witnesses. “I only came out when the police and rescue services were already there. I have nothing to do with it.”

Ahmed N. contradicted this: “He then told me that he had hit him with brass knuckles. But I didn’t see anything.’ Witnesses said that Gerhard B. had bragged about the crime. His DNA traces were found on the weapon, which was seized three days later.

Two reports
The fight was preceded by the fact that T. had groped two girls (14 and 15 years old) from acquaintances of the suspect in the discotheque and they wanted to confront him about it. The man had 2.46 per mille in his blood.

According to a forensic report, the two blows did not result in death.

A private counter-evaluation shows a diametric result.

The trial continues on Wednesday and the boys face a prison sentence of five years.
