When his victim was already on the ground, a 27-year-old allegedly rammed a knife into his back with full force. The court finds it particularly ‘treacherous’. The young Viennese was sentenced to twenty years in prison – just below the maximum sentence for attempted murder.
A collision at the zebra crossing – that would have prompted a young man to stab a 37-year-old in the back. “He literally cut me to pieces,” the victim said on the witness stand, describing every detail of the March incident. He crossed the street completely carelessly, the defendant brushed against him and then repeatedly shouted: “Come here! Come here!”. Instead of fleeing, the Viennese faced a confrontation…
The suspect claims to have been attacked himself
Which ended with emergency surgery for him. “He rammed the knife into the victim’s back with a powerful stab,” the prosecutor at the Vienna Regional Court accused the 27-year-old of attempted murder. But in court he appears innocent. He was walking in Vienna-Favoritites: “I was relaxing listening to music and suddenly I was attacked from behind.”
He does not know how he could be linked to the 37-year-old’s stab wound. “I have never carried a knife in my almost 28 years,” he assured judge Stefan Apostol. Defense lawyers Sebastian Lesigang and Andreas Schweitzer also speak of “very unclear evidence.” Neither the recognition of the victim by the police nor the DNA traces found were clear.
“Treasonous” acts require severe punishment
But enough for the jury. They sentenced the Viennese to 20 years in prison in accordance with the charges. Judge Stefan Apostol explains that the stab in the back was particularly “treacherous”. Too much, says the defense and immediately appeals on behalf of their client. The judgment is therefore not legally binding.
