Not legally binding: four years in prison for theft without loot

That’s bitter! Robbed a tobacconist in the hope of making a quick buck. Then a determined employee and escape penniless. And now four years in prison. Two friends do not want to believe that and appeal against the verdicts.

The attack went horribly wrong, but two friends (30, 27) still had to appear in the Wels Regional Court for aggravated robbery – with a sentence of up to 15 years in prison. They allegedly robbed a tobacconist in Wels on July 20.

The duo had come to the tobacconist in the afternoon unmasked and ‘disguised’ as customers, when suddenly one of them pulled out a knife and demanded money. But the determined employee, who immediately closed the cash drawer and raised the alarm, intimidated the perpetrators so much that they escaped without any loot.

The camera recorded everything and the older suspect was quickly caught. He denied everything and led police to the alleged main perpetrator, who led investigators to the knife he used, which he had thrown away in a park.

In court, the younger man stood up to his responsibility and admitted everything. The older man insisted: “I did nothing” and denied everything until the verdict was announced. Each of the two defendants was sentenced to four years in prison. The younger man thought it was too severe a punishment and appealed against the amount of the sentence. The 30-year-old appealed in full because he didn’t want to be there. The rulings are therefore not legally binding.
