A long criminal record ultimately proved fatal for the duo after a fight that ended with six stab wounds. The 16-year-old perpetrator had played the big man in prison, but then became quite subdued in court in Upper Austria.
“We made the wrong decision” – the insight of a 16-year-old from Mühlviertel and his friend and self-proclaimed protector (29) before the jury in Linz came too late. On the night of August 1, they were provoked by a drunken acquaintance on the main square of Linz, after ‘talking to him’ about the younger man’s ‘ex’ and missing €100.
After a taxi driver chased them away, the 21-year-old brandished a knife behind them and folded it as they turned around. Because they came back and wouldn’t leave him alone. That was the first big mistake.
Surveillance cameras filmed everything
And while the youngest held him in a headlock, the eldest stabbed him in the back six times with the “kicked” knife – mistake number 2. This was also documented on surveillance video and confirmed by two taxi drivers, one of those in the first scuffle had intervened.
The older man, who had six previous convictions, was sentenced to 30 months in prison for causing grievous bodily harm with intent. His lawyer wanted to get rid of the “intention”, but the jury saw no possibility of that with six stab wounds. The penalty was two to fifteen years in prison.
Career dream: “Millionaire in the bank”
The 16-year-old who wanted to be a ‘millionaire in the bank’, who had already made a threat against the infamous 14-year-old serial offender, now in custody, was jailed for three months. If it weren’t for his past life, it probably would have been a suspended sentence and he wouldn’t have been in custody since that day. But he has four previous convictions in two years, and several months were open to probation. The judge – he had conducted the trial in a calm and balanced manner, had given good reasons for the verdict and had consulted with the lay judges for almost 45 minutes – chose a path that was acceptable to everyone: three months in prison for this crime. In addition, four weeks of a suspended sentence were “broken” – a total of four months in prison: “Anything else obviously doesn’t help. A call sign should be created,” the judge said. Because the 16-year-old had already committed four administrative violations while in custody, the judge urgently advised him to reform: “Otherwise the parole will not work.”
“I will continue as before”
The reading of an interview at the youth detention center caused horror, in which the 16-year-old said he would always tell the judges he would get a job and stay away from alcohol and drugs, but in reality he would carry on as he has until now. This time too, he promised in court that he would get better and that he wanted to get his school leaving certificate.
