Railing broken – carnival accident: five men have to pay a fine

Colorful costumes, donuts and parades: Carnival is celebrated every year in February. The latter resulted in a serious accident in Reisenberg near Baden in Lower Austria. When the fall protection of a fairground float broke, about twenty people fell onto the street. It is said that five men are to blame.

A tractor driver and four skilled professionals took part in the carnival parade for the first time and worked together to convert a low loader. “They did a shake test on the railing and found the car suitable,” the prosecutor said. Because he collapsed in a left turn. In addition to the unstable construction, there were far too many people on the low loader.

17 people injured due to negligence?
And that resulted in injuries: nine revelers were slightly injured, eight were even seriously injured. When we took a closer look at the trailer on which an entire punch hut was built, it became clear: the railing we built ourselves was inadequate. The defendants were responsible and are therefore now accused of bodily harm due to negligence in 17 cases at the Wiener Neustadt Regional Court.

The men between the ages of 25 and 40 sit in a row on the dock. The responsibilities are similar across the board: “We are responsible for what happened. But not in the context that the moving van was poorly built. We did not take this lightly. It had to work and fit, otherwise we would not have participated.” The more than ten injured were the result of a tragic accident.

No instructions from organizer
As far as they knew and believed, the safety of the celebrants – mostly from the circle of friends of the Lower Austrians. There were no advance instructions from the organizer, the volunteer fire brigade. “The five of us agreed on how we were going to do it,” the truck driver recalled in court.

Tractor driver fled after accident
In addition to negligent conduct, the plaintiff accuses him of abandoning the injured. Unlike his co-suspects, the 33-year-old fled shortly after the accident: “I saw people falling. Then I saw it black and just left. “I felt like it was all my fault” – after all, he was driving the tractor.

However, all five are responsible for the negligent bodily harm of seventeen people. The five Lower Austrians must pay partial fines of between 2,280 and 4,320 euros. The judge ruled that the tractor driver did not abandon the partygoers. The statements are not legally binding.
