Things are happening in the Viennese club scene. This is evident from three lawsuits being heard at the Vienna Regional Court. It’s about discarded glasses, missing phones and an accidental broken nose.
Three defendants – all in their mid-twenties – have to take their place in the dock in Vienna. In different negotiation rooms. But the accusations are similar: the Public Prosecution Service accuses them of violent crimes in and in front of nightclubs.
The insults turned into a push, after which the Viennese’s first punch followed. But he didn’t hit his actual target – a 23-year-old – but his female companion. “It was absolutely not my intention to hit the girl. “I’m really ashamed of it,” he swears repeatedly and angrily.
Broken nose and tears in court
The 21-year-old suffered a multiple broken nose and burst into tears on the witness stand when she saw the photos from hospital. She and her male companions describe a very different version: Although there was a discussion, the suspect did not intervene in any way to mediate. “He shouted that it was his club and that there was no fight here,” after which the devastating blow came.
The charge is attempted grievous bodily harm, in which he also injured the 23-year-old – and negligent bodily harm in the form of a broken nose. The Public Prosecution Service also assumes that there was intent. The hearing is adjourned for further witnesses.
Drinking glass thrown at opponent
However, a 23-year-old Viennese is said to have acted deliberately. He was partying in the well-known disco “Volksgarten” in the 1st district on the night of December 9, 2022. There, during an argument, he hit someone who was five years older than him. And that wasn’t enough: the young man threw a drinking glass at his opponent, which hit him on the cheek and left him forever disfigured with a scar.
The suspect appears in court with his parents and makes a full confession. Judge Philipp Schnabel does not have to fully exploit the threatened sentence of up to fifteen years for intentionally causing serious bodily harm with lasting consequences. “You also have to take into account that it was an unfortunate outcome,” he emphasizes, explaining how the victim’s injuries occurred. A 24-month suspended prison sentence would be sufficient punishment for the innocent person.
Mobile phone theft in the Donaukanal club “Flex”
A 27-year-old does not get off so lightly at the Vienna Regional Court. He was sentenced to five years in prison, including for theft. In front of the restaurant ‘Flex’ on the Danube Canal, he first knocked down Roland M., who was on his way home, and then took his mobile phone and debit card.
A mistake – the defendant answers before judge Andreas Böhm. Although he admits that the young man was punched in the face, there was no robbery. He saw the phone on the floor, thought it was his and then plugged it in, lawyer Andreas Reichenbach said. He also states that only one mobile phone was found on the 27-year-old.
However, the jury finds the Syrian guilty as charged. Because Reichenbach was missing two witnesses for the trial, he immediately filed a nullity complaint on behalf of his client. The judgment is therefore not legally binding.
