An argument in an apartment in Meidling escalated: the victim suffered a cut to his skull. The accused Viennese could only remember a bloody knife in his hand. But the court ruled that it was not attempted murder.
A night marked by gaps in memory. Because no one really wants to remember what happened on July 10, 2023. But the fact is that a 26-year-old suffered a 25cm long gash on the back of his head – reaching down to the skull bone.
Kitchen knife pointed at strangers
That is why a 39-year-old now has to answer before the Vienna Regional Court. The charges against lawyer Clara Abpurg’s client are serious; it is attempted murder. His girlfriend would go through the house with two male acquaintances, one of whom was the later victim. She invited her companion to the apartment in Vienna-Meidling, where her now accused boyfriend was waiting.
As is often the case, an argument ensued. One of the men present asked if everything was okay. “Herst, can’t you hear us talking,” was the 39-year-old’s aggressive response. He then attacked the 26-year-old with a kitchen knife, who luckily avoided most of the stabs.
Just know that he had a bloody knife in his hand
The suspect Viennese’s version is, as is so often the case, different: the strange man had a Stanley knife with him and had pushed him to the ground. He then told police that all he knew was that he had a bloody knife in his hand. He was attacked.
His criminal record shows that he has exhibited violent behavior in the past; he has already been convicted four times. And now there is a fifth time: the jury acquits the 39-year-old of attempted murder, but answers the question of attempted intentional grievous bodily harm in the affirmative.
According to prosecutors, the cut on the victim’s skull is only a minor physical injury. He sentenced him to seven years; the Public Prosecution Service accepted the sentence. The Viennese asks for time to think about it.
