A 66-year-old who had been running a brisk trade in cocaine, drug substitutes and psychotropic substances in Vienna since 2020 and had exploited the drug addictions of three much younger women for sexual acts, was sentenced to ten years in prison at the regional court on Wednesday.
The man has made a full confession to the drug offenses. “Normally I don’t ask women anything,” he said in his interview. However, he did not behave like some kind of Good Samaritan towards drug addicts and gave them the drugs for free. Instead, he paid back for the drugs with sex acts.
“Public secret”
“It was an open secret in the drug scene that you could get drugs from the suspect for sex,” the prosecutor said. A number of women “willingly accepted this offer under the motto ‘It’s great that you don’t have to pay anything for cocaine,'” the prosecutor continued.
Some women were homeless
As far as sexual criminal law is concerned, this is not a punishable offense: “In three cases, however, he took advantage of the drug addiction of the women involved. The three were partly homeless and in a difficult situation. They saw no other option but to close this deal.”
Almost unconscious
According to the final judgment, the 66-year-old violated the sexual self-determination of these three women within the meaning of Article 205a of the Criminal Code. In addition, he was found guilty of sexual abuse of a defenseless person (Article 205 of the Criminal Code) in two of the three victims. He let them both stay overnight in his apartment and had sexual intercourse with them several times after they were in a similar state, sometimes on the verge of unconsciousness, as a result of the drugs they had taken. The 66-year-old filmed these scenes on his mobile phone and saved the material, which was recovered during the review of his mobile phone records and included in the court file.

“The videos speak for themselves,” the chairman said in her judgment. It shows “completely motionless women” and it is “clear to everyone that they are in a defenseless state.” The 66-year-old, who has amassed a total of 25 previous convictions – including 20 relevant ones – at home and abroad since the 1970s, admitted the charge of using sex as a means of payment.
“Took advantage of the opportunity!”
“I just didn’t think about it. To some extent I took advantage of the opportunity,” said the Carinthian resident. However, he denied that he had abused women in a defenseless state: “When you use cocaine, you don’t tip from left to right.” The women were “fit,” he claimed. The court did not believe this. The women – two had testified as witnesses, one did not show up and could not be contacted by police due to the lack of a loadable address – were “absolutely credible”, the chairman emphasized: “There is not an iota of doubt about what they said .”
The 66-year-old had sold more than a kilo of cocaine and at least 800 Substitol tablets. He bought the substitute himself from a pharmacy to control his own addiction. When he was clean, he continued to go to the pharmacy and deal in the pills, “because the rent is 750 euros a month,” as he said on the record. The man accepted the punishment imposed on him. The verdict is already legally binding.
