Incident in Graz
The starting point was an incident in the dog park in the Volksgarten in Graz. A business owner was walking her sister’s dog. Two friends did the same with their Dalmatian and a German Shepherd. But then it happened: while romping, the two four-legged friends hit the 60-year-old so hard that she seriously hurt her knee. The woman then went to court and, to the shock of the student and the employee, demanded around 20,000 euros in damages.
The due diligence investigation was not forgotten
An expected incident at a dog park, or have the women neglected their duty of care? Does it even amount to a leash obligation in dog pastures? At least in the first instance, the court has now made a decision. The judge could not find any negligence on the part of the dog owners and the two women did not have to assume that the situation was particularly dangerous. It was just an unforeseeable accident.
Lawyer Christian Fauland, who represents the women in suits and sees a dog park reduced to absurdity by such a lawsuit, is satisfied: “The court has handled all facets of the case very carefully. A stage victory in the first instance that is representative of all dog pasture users.”
