17-year-old suspect – Short trial expected after accident with two deaths

Date:

45 minutes are scheduled – the accident with two fatalities that rocked Upper Austria this summer will most likely be settled quickly in court. A 17-year-old who drove too fast shortly after taking his driving test should be held liable.

Flashback to June 12 this year, 10:10 p.m.: A few hours after successfully passing the driving test, a 17-year-old boy from Kirchschlag lost control of his father’s Toyota Corolla. There are two girls in the car and the car crashes into the oncoming VW Passat driven by Benjamin L. (36) from Hellmonsödt.

The 36-year-old – his girlfriend and child mourn him – died immediately, Franziska G. (16) from Altenberg died in the passenger seat in the new driver’s car – the accident happened within sight of her parents’ house. Sophie G. (16) from Altenberg survives seriously injured in the back seat. The 17-year-old driver of the crash also survived with serious injuries.

After the accident, the young Kirchschlager tried to explain – there was talk of an oncoming car blinding him. There is nothing about this in the indictment. However, he was driving at too high a speed, ended up on the shoulder and then began to drift when he counter-steered, causing the car to crash into oncoming traffic.

Half the fine applies
Because he was a new driver and allegedly drove at too high a speed in the dark, the 17-year-old will have to answer Tuesday from 8:30 a.m. on charges of “murder by gross negligence” and “physical injury by gross negligence”. Due to his age, the juvenile court sentence applies to him and the sentence is halved – he can expect a maximum of 18 months in prison. The verdict is already scheduled for 9:15 am.
