Trip with consequences – 17,000 euros fine for accident with car-sharing car

Lower Austrian Sherif E. will never forget February 18, 2021. An accident with a car from a well-known car sharing company cost him a total of 17,000 euros. When the 24-year-old wanted to have a report drawn up after the crash, the car had already been sold.

On February 18, 2021 around noon, firefighters were called to rescue an accident wreck at the intersection of Siebenbrunnengasse – Gaudenzdorfer Gurtel in Vienna-Meidling. There was serious damage to the sheet metal, but no injuries were reported. The driver of the accident was Sherif E from Lower Austria, he admits he was probably driving at a speed of just over 50 km/h. An expert opinion supports his statements.

Exemplary behavior after an accident
As usual, he immediately contacted the car-sharing company where the mechanic had borrowed the car. So are the police. E. also voluntarily took an alcohol and drug test. The driver, who was quite experienced for his age, did not want to make any accusations. He himself suspects that the reason for the crash was a defect in the car.

Wreckage was removed from the world
But he was never able to verify this theory: the company sold the car immediately after the crash. He was bombarded with terrible demands for payment. Only 7,000 euros as a settlement offer, which the 24-year-old did not want to accept. The young father has now incurred 17,000 euros in follow-up costs. “A financial horror”, as he describes it to the “Krone”.

Lawyer warns: “This could happen to anyone!”
His lawyer believes the verdict is ‘legally justified, but incorrect’. The charge of gross negligence normally applies to running stop signs, red lights or driving under the influence of alcohol. Now they both want to warn others to whom this could happen. When asked by Krone, the company did not want to comment on the “ongoing procedures” – but everything went well. Nevertheless, the conditions were changed at the end of the year, including improved insurance benefits.
