Now in custody – groom (27) arrested at his own wedding

Shortly before the wedding ceremony, immigration police officers arrived at Vösendorf Castle on Saturday. The groom (27) has been in custody ever since. The soon-to-be-bride’s lawyer is now fighting the threat of deportation.

It should have been the best day in the life of a Turk and his future wife (40). But the groom was arrested in the middle of the civil ceremony at Vösendorf Castle. The 27-year-old has been in custody ever since.

Background to the intervention: Ten days before the wedding, the Kurd, who has lived in Austria since 2022 and has not yet completed military service in his home country, received a negative asylum decision. If he had said yes to his German partner, whom he met in the company of his uncle, who had lived in this country for years, he would have immediately received a residence permit.

“You could have waited…”
Lawyer Gregor Klemm, who specializes in asylum and immigration law, is now fighting tenaciously to keep the 27-year-old in Austria. Because for him the police action was not proportionate. “You could have waited until the marriage was consummated, but you wanted to avoid that at all costs. Otherwise the intervention would of course no longer be necessary.”

Staple refers in particular to a similar case from 2016, in which the court successfully intervened against the arrest. “Even then, an asylum seeker in Austria wanted to marry an EU citizen.”

A complaint has now been filed against the detention pending deportation. However, the lawyer expects an eviction attempt in the coming days.
