On Friday, the man was sentenced to three and a half years in prison by the Feldkirch Regional Court for serious sexual abuse of a defenseless person. He must also pay 4,000 euros in partial compensation to the victim, a 24-year-old woman.
The defendant had always protested his innocence and claimed to have had consensual sex with the woman. But the jury did not believe the man. Different in relation to the victim. “The woman’s incriminating statements were credible,” chairman Silke Sandholzer said during the second hearing.
Alcohol and marijuana consumed
The 24-year-old roommate in a homeless shelter stated both to the police and in the hostile interview that she had consumed alcohol and marijuana that evening together with the suspect and other residents in the tea kitchen of the Kaplan Bonetti House in Dornbirn. When the “drinking” was over and everyone went back to their rooms, she went to the defendant “to chat” and have a joint. She suddenly felt ill there.
The suspect allegedly took advantage of the defenselessness of those crouching on the ground and sexually assaulted the woman. Only after the crime did she have the strength to free herself from the situation and vomit in the bathroom.
With the 24-year-old claiming she may have been incapacitated with knockout drops due to her inability to move at the time, a toxicology report was ordered but came back negative.
Expert Marion Pavlic therefore denied the immobility described by the victim, but admitted that there was a delayed reaction time due to the consumption of cannabis and alcohol. Lawyer Hanno Lercher has already filed an appeal for nullity, a criminal appeal and a complaint against the award of damages for pain and suffering, and public prosecutor Julia Berchtold also wants to appeal.
