Stein Prison – Double manslaughter complains of bullying in prison

In 2016, an irritated family man, who was almost constantly harassed by his neighbors, murdered a retired couple in Leonding. Behind bars, the man who was completely innocent until his crime, a double homicide, receives strange special treatment, for example as a strict non-smoker and placed with smokers.

It was a double murder in which only the perpetrator was remorseful. In February 2016, an innocent family man (then 41) stabbed a couple (she was 72, he was 74) with an iron bar in Leonding, after years of dispute between neighbors. Both died in hospital.

Neighbors raised money for the lawsuit
The couple had previously bloodied their neighbor and his young family. With advertisements, complaints and insults. Before the trial, the other residents raised money for him. The mayor of a Wachau community where the murdered couple had a second home even said dryly to the TV camera: “We only feel sorry for the murderer.”

The higher court increased the sentence by two years
The double manslaughter was initially given seven years and then nine years by the Linz High Court. He first served his sentence in Garsten prison. Then, according to his lawyer Andreas Mauhart, the “exemplary prisoner” was transferred in a completely unusual manner in a night-and-dagger operation to Linz and there to the pre-trial detention department, where there was no help.

Strict non-smokers became nicotine addicts
Six months later the double murderer was transferred again, this time to the ‘tough boys’ in Stein prison (Lower Austria). And there began – according to his mother and defender Mauhart in unison – “a path of suffering”. First, the strict non-smoker was transferred to a multi-bed cell with many smokers, then, after a complaint, to a hepatitis patient.

Report of resistance
“The sick person shaved where the dishes were done. No wonder my client wanted to get out of there,” Mauhart said. Finally, the convicted man would be sent to a new cell, but again to a chain smoker. When he refused, saying force would have to be used to get in there, a prison guard filed a complaint for resisting. The first day of the trial was postponed due to the hearing of witnesses. “The whole thing is ridiculous,” said attorney Mauhart.

Second round on Friday
Moreover, the second prison guard involved stated during the procedure that he had not noticed this, according to Mauhart. The second round will take place on Friday at the Krems Regional Court. The manslaughter case was actually supposed to be released in August.

No personal information
The Stein prison does not want to provide personal information, but assures that the different sensitivities of the prisoners, such as nationality, language or religion, are always taken into account when receiving prisoners.
