Five months probation – Convicted of failing to euthanize a sick dog

The male “Aiko” (12) had no control over the back half of his body since an accident and was in a lot of pain. Because his owner did not allow him to be treated or euthanized, he was initially sentenced to seven months in prison for animal cruelty. He appealed against this.

A convicted animal executioner did not want to ‘fight’ the verdict before the Linz Regional Court on Wednesday because the word disgusted him. He “just wanted to make a few things clear”: “Aiko” was his favorite dog.

Poor condition
The German Shepherd mix had lost control of the back half of his body since an accident. Despite a lot of pain, limited mobility, incontinence and his old age (12 years), the male was kept outside all year round.

Euthanasia required
For the owner and the alternative association to which he belongs, medical treatment and euthanasia were not an option. Not even when the official veterinarian finally demanded that the male be rescued. That is why a report was finally filed and charges were filed. The ‘master’ was convicted at first instance of animal cruelty before the regional court of Wels. The convict appealed against this.

Penalty reduced
On Ash Wednesday, the appeals court in Linz rejected his request for acquittal, but reduced the suspended prison sentence from seven to five months and extended the probation period to five years. In addition, the convicted person must pay the costs of the procedure; the judgment is legally binding.
