A Somali (26) attacked a 44-year-old Tyrolean with a broken glass bottle during an argument in the Bogenmeile in Innsbruck. Now the man had to appear in court. But was the crime attempted murder?
Serious bodily harm, sexual abuse of a defenseless person – and attempted murder: the list of charges the 26-year-old faces in court in Innsbruck is long. However, the most serious incident was the one that occurred on August 5, 2023 at approximately 4 a.m. in the Bogens.
15 centimeter long cuts
The 26-year-old got into an argument with a resident in front of a bar because of a lot of alcohol and drugs. After his opponent punched him, the Somali grabbed a glass bottle and broke it on the edge of the sidewalk, seriously injuring the 44-year-old. “Given the 15 centimeter long gashes in the neck area, it is a miracle that the victim is still alive,” the prosecutor said.
For defenders it was self-defense
The man’s lawyer also admitted to the attack itself: “In my opinion it was self-defense.” Finally, his opponent gave him a violent blow first. His client ‘just wanted to scare him’ and did not inflict the injuries deliberately.
“Heavily drunk and in bad shape”
The reconstruction of the crime with the suspect subsequently proved to be lengthy. The man, who said he regularly drank large amounts of alcohol and cocaine, emphasized that he was heavily drunk that night and was in bad shape. “After the blow I probably became quite aggressive,” he admitted after repeated questions.
Suspect had ‘lost control’
When chairman Norbert Hofer asked if he knew what could cause such an attack, he ultimately said that “it could be fatal.” He also “lost control” during the argument and “freaked out,” describing his emotional state on the night of the crime. This was also confirmed by the man who was interviewed as a witness and who was seriously injured by the suspect during the ‘bends’: ‘It all happened very quickly and I already had the bottle down my throat.’ He “had no memory of his own” of the reasons for the dispute and the exact sequence of events “remembered”, also due to the high level of alcoholism.
The verdict is expected on Wednesday
A forensic medical report is scheduled for Wednesday. On Wednesday, the jury will finally have to decide whether the man is guilty or innocent.
