A court in Vitoria-Gasteiz has annulled the commission (10 euros) after estimating a request from the consumer association EKA/ACUV, which warns that it will “continue to prosecute” entities that continue to charge.

The Santander Bank should stop charging the commission for deposit cash at the counter (10 euros), after the judgment of the Commercial Court No. 1 of Vitoria-Gasteiz became final. The Basque Association of Consumers and Users, EKA/ACUV has reported that the financial institution has withdrawn the appeal it filed, and therefore compliance is now mandatory.
In a statement, EKA/ACUV recalled that it has filed an injunction against the commission, which has been confirmed by the court. So from now on, the entity must “abstain from charging” this commission and return what has been paid for this concept so far.
In addition, the bank will have to remove “the information related to its structure from the brochure with commission rates, conditions and costs”, as laid down in the judicial decision.
EKA/ACUV confirmed that in this way “the nullity of said commission is generalized and its withdrawal is therefore immediately imposed by all entities”. If not, did he explain that? “It will continue to sue anyone who persists in using it.”
The Consumers’ Association recalled that “in addition to these, several commissions have already been annulled, such as, for example, the commission for cash withdrawals at the counter, the claim for debtor positions and the commission for carrying out transactions that can be done through the cashier”.
