Victim in need of care – uppercut ends fatally – but perpetrator acquitted

An argument at a petrol station in Lower Austria ended with a 39-year-old man losing his ability to speak. The father of two girls will continue to need care. The acquittals are legally binding. The events of the crime could not be precisely reconstructed at the trial; the witness statements were contradictory.

Two brothers, Emir and Teo, wanted to speak out at a gas station in Mistelbach (Lower Austria) – it involved about 20 euros that had been borrowed and not returned. But instead of reconciliation, the argument escalated. When Emir brought in a giant bat to support him, a couple of brothers who were his friends got involved – and ended up in court in Korneuburg for deliberately causing grievous bodily harm with serious long-term consequences. The “Krone” reported on the case.

Suspect: “I only defended myself”
“The giant was still in the car and had a knife. My client therefore kept the door closed,” says lawyer Andreas Strobl in the trial, which started in May 2023 and lasted several months. “While I was closing the door, Emir came up to me and wanted to hit me. “I was just defending myself,” said the 28-year-old main defendant.

The resistance had fatal consequences. Emir, who has two small daughters, hit his head on the ground after the uppercut and lost his speech. “He is now a nursing case,” said Astrid Wagner, a representative of the victim’s family.

The evidentiary process did not provide a clear picture of how exactly the incident occurred – which is why Strobl’s client and his brother were acquitted. “The verdict has already become final,” the lawyer said.
