Another case of police attacks was heard before the Vienna Regional Court: a climate activist was allegedly groped in her private space by a police officer in police custody after a protest “without reason”. The action was ruled unlawful by the Vienna Administrative Court.
It is the third time that Last Generation activists have won such a case. This time the victim is 25-year-old activist Jelena Saf. A similar incident took place last May. At the time, activist Laila Fuisz (23) allegedly had her vulva and buttocks groped by a law enforcement officer. She also won the case in December.
Activist had to pull down her underwear
Lawyer Clemens Lahner explained on Tuesday: “The Vienna Administrative Court declared both the order to pull down the underpants or the groping through the underpants unlawful, as well as the fact that the officer left the door open when leaving this room ordered. Jelena Saf not very euphoric about success
The 25-year-old responded to her success in court with little euphoria: “Our protests seem to reveal structural grievances in the way the police deal with citizens. I can’t imagine what could happen to people in custody who, like us, cannot defend themselves.” The young woman emphasized that all these humiliating police measures would not be necessary “if the government finally takes action and enshrines a fundamental right to climate protection in the constitution, our protests will stop immediately. And with it these unnecessary arrests and vilifications.”
Lawyer Lahner added to the court’s final decision: “The law does not end at the threshold of the police detention center, but also applies to the police.”
Super glue suspected in underwear
In September and December last year, the Administrative Court also ruled in similar cases that such police measures, such as naked exams, were unlawful. Before Fuisz (23) won the case in December, there was a similar success in court at the end of the summer. The victim was a 24-year-old activist. Last spring he was also forced to take off his underwear during a demonstration. Police defended themselves by saying they suspected superglue in the man’s underwear.
