Doctors accused – “gods in white” were not bribes

A cancer specialist and a pharmacist had to share the port in Vienna because they acted too humanely for their patients. The judge really liked it.

They worked hand in hand, the university professor, who is an oncologist, and the pharmacist from Vienna. They did something to their credit, but alien to the system. Namely to provide cancer patients on the spot with the medicines that have to be taken within a tight time window.

The pharmacy reservation
Unlike country doctors with home pharmacies, this is prohibited for hospital doctors. Because there is the “pharmacy reservation”: the doctor writes the prescription, only a pharmacist has to dispense the medication. The hospital pharmacy is reserved for hospitalized patients.

WKStA accuses
However, these special cancer drugs are not always in stock. Those affected have other concerns – and are sometimes physically unable to make multiple trips to the pharmacy. So the pharmacist took the medicine to the professor, who gave it to the patients. “Official business,” the WKStA said – and accused. Because it’s also about the prescription fee.

No bribery
Judge Christian Böhm listened long and intently, learned a lot about doctors, their concerns and prescription fee waivers (which almost every cancer patient has), and acquitted the two defendants — who are anything but “gods in white” (lawyers Kollmann/Rebisan). Because with the issuance of the regulations, the “official business” was correct – and thus no bribery or corruption.
