A ‘pleasure massage’ in a Tyrolean hotel in September of the previous year landed a German-born man (60) in court. The masseur is said to have sexually abused a holidaymaker. Ultimately, it was clear that a “sexual incident” had occurred – but not in what form.
“He raped me,” the woman, who actually wanted to relax for a few days with her partner in the Ötztal, is certain. The defendant first offered to massage her “from the inside,” then penetrated her with his finger and finally tried to penetrate her.
Victim may have made ‘sexual innuendos’
The German described the case very differently on Monday during the hearing at the Innsbruck regional court. “She continued to make sexual innuendos and we also specifically discussed what was meant by from within,” he explained. It was also she who eventually took off his pants and underwear and encouraged him to have intercourse.
They agreed on only one thing: the case ended with the man’s premature ejaculation before intercourse could even take place. “Then she lay back on the massage table and let the massage end,” the man described the situation at the time.
The public prosecutor doubted the suspect’s version
The prosecutor had doubts about the man’s version that the initiative ultimately came from the alleged victim: “Why would she, as a lesbian woman, have been interested in a much older man?” The man had also clearly crossed boundaries, including those between guest and hotel employee.
In any case, the suspect’s lawyer did not see the act as rape: “The woman could have simply left the room after the incident.” There was no violence or deprivation of liberty, she argued.
Decision for “acquittal in doubt”
The jury, chaired by Judge Thomas Wallnöfer, was ultimately unable to determine with certainty what was really going on. “If in doubt, an acquittal follows,” said Wallnöfer. But one thing is clear: ‘There was actually a sexual incident’, but in what form it ‘cannot be determined exactly’.
