In a landmark ruling, the European Court of Human Rights (ECtHR) condemned Switzerland for its lack of climate protection. Judges agreed with a group of seniors who accused the government of not doing enough to protect the climate.
According to experts ahead of the decisions, the Strasbourg statements could be a turning point in the fight against climate change. The rulings could force governments to implement more ambitious climate policies.
The ECtHR was established in Strasbourg in 1959 by the member states of the Council of Europe to ensure compliance with the 1950 European Convention on Human Rights. It does not contain any explicit provisions on environmental protection.
Nevertheless, in previous cases involving industry and waste management, the Court required states to maintain a ‘healthy environment’. The judges referred to Article 8 of the Treaty – the right to respect for private and family life.
