Baby abused – parents are now threatened with trial before a lay judge

Surprising verdict in the trial against the parents of little Asif. According to the explanations of the medical expert, the single judge in Linz has rendered a judgment of incompetence. If this becomes final, the couple (26, 24) will face a new trial for intentionally causing serious bodily harm.

During Tuesday’s trial, “merely” tormenting or neglecting underage, younger or defenseless people was charged. The sentence is a maximum of three years. Asif, who is now two years old, is said to have been so badly abused by his parents as a baby that he was diagnosed with broken ribs, both upper arms, collarbone and thigh at the Kepler clinic in Linz. The parents – an Austrian (26) and her husband (24) from Bangladesh – deny having anything to do with the injuries.

Mass violence
“The thigh is the most massive bone in the body. Fractures are also very rare in infants,” said the medical expert in Linz on Tuesday before a single judge. Clumsy handling of the baby cannot cause such injuries. “This requires the most massive use of force,” said the doctor, who a similar conclusion came with the broken ribs: “Such injuries are only possible in the context of physical abuse.”

New trial for intentionally causing serious bodily harm
Judge Klaus Bittmann issued a verdict of incompetence. He assumes that he intentionally inflicted serious bodily harm and this crime has to be decided by a lay judge, which carries a sentence of one to ten years. Prosecutors and lawyers have not made a statement. The verdict is not yet legally binding.
