The case surprised the entire country: a farmer’s wife from Lower Austria allegedly severely beat her husband because she had caught him red-handed with a young dairy assistant. Now a report has been found: the impostor suffered “minor” injuries, but the complaints, which he said lasted for several months, were not understandable.
The operation report of the accident is now available in the lawsuit against a 40-year-old Lower Austrian farmer from the Baden district. It confirmed that the 44-year-old suffered a cracked skull with bruises, bruises on his back with bloodshot streaks and a bruised shoulder.
The expert assumes ‘blunt force’ as stated in the report: ‘Taking into account the file situation, the injuries in question could be the result of at least three blows with an elongated object (handle of a rubber scraper or the like) against the back and another blow (whether with a fist, a bucket or a scraper cannot be distinguished from the perspective of an accident operation).”
The man was “slightly” injured
The expert classified the injuries as “mild” and the man’s alleged months-long complaints were “not understandable from the perspective of an accident operation.” On the issue of possible self-harm, the expert notes that “intentionally hitting the back of the head against a solid obstacle” “can of course be done yourself.”
Injuries to the back, on the other hand, require a more complex technique or a corresponding flexible tool or an impact tool with a joint.
Woman in court for assault
The 44-year-old’s wife has had to answer for bodily harm at the Baden court since mid-February. She pleaded ‘not guilty’ at the start of the trial. Her lawyer Lukas Kollmann was convinced at the time that the husband, who was fully clothed at the time of the alleged assault, would have worn too many layers of clothing to sustain visible injuries from the mop.
The alleged assault took place on April 24, 2022 at the couple’s home in the Baden district. She wanted to help her husband feed the calves that evening. After opening the stable door, she stood “transfixed. I caught him red-handed. It was as if the ground had been pulled from under someone’s feet,” the 40-year-old described to the subdistrict court judge on the first day of the trial.
She wanted to ‘confront’ the man. The suspect has assured that she did not use any tool in this context and did not strike with it. She simply filled a bucket with water and poured it over her husband, after which he sprayed water into her eyes with a hose.
The trial is entering its final round
“The expert report confirms the statements of the victim and his milking assistant about what happened in the stable. The course of events and the consequences of the injuries must be consistent with their descriptions. No form of self-harm could be identified. Both the divorce and the criminal proceedings are now entering their final round,” said Michael Dohr, the man’s legal representative. It is still unclear when the expertise in the field of trauma surgery will be discussed in court. There is no date yet for the next hearing.
