Three people received compensation for the cancellation of a flight and the resulting three-hour delay, the fourth was not yet far away. Only a lawsuit led to success.
Elisabeth and Hubert Temel from Rotenturm an der Pinka have traveled “three quarters of the world”. “We have never experienced such injustice before,” says the 65-year-old.
What happened? In the autumn of 2023, the people from southern Burgenland were in Spain and boarded an Iberia plane in Madrid that would take them to Vienna-Schwechat. After half an hour on the track it was said that the rudder was defective. So get off the plane and wait. The Temels eventually arrived in Austria three hours late. They now exercised their right to claim compensation from the airline.
Hubert Temel and a couple who had participated in the trip each received 400 euros transferred without any problems. However, Elisabeth Temel was the only one who looked through her fingers. It was stated in writing: “In your case, our options for action were limited by circumstances beyond our control.”
“Really incomprehensible”
What must we do? We checked in vain with the consumer protection department of the Chamber of Labor and with the travel agency where the flight was booked. “Thank God we have legal expenses insurance,” said the 59-year-old, who turned to Oberwart lawyer Martin Behal. “It is really incomprehensible that three people receive compensation and the fourth does not,” said the lawyer, who filed a lawsuit. “Why should women in particular have exceptional circumstances?”
