After years of ‘radio silence’, a then 32-year-old met his father (63) in June 2023 at his sister’s wedding reception in Bad Häring. The son lashed out in the argument and his father died in hospital.
Attack resulting in death
In November, the 32-year-old was sentenced to four years in prison for assault causing death, but he appealed. “My client showed remorse during the hearing in November and is already confronted with the ruins of his existence,” his lawyer argued during the appeal hearing. This means that the man – who was under significant influence of alcohol at the time – was “sufficiently punished” with a partial prison sentence or the minimum sentence of two years.
“The reasons for mitigation have already been taken into account”
The Higher Regional Court saw this differently. The mitigating factors were already sufficiently taken into account during the main hearing. With a sentence range of up to fifteen years, there is no room for maneuver anymore, especially because the sentence at the time was already ‘in the lowest range’.
