The Supreme Court of the Basque Country (TSJPV) has ordered the company Construcciones y Auxiliar de Ferrocarriles (CAF) to pay the seniority bonus to all its employees.
At the initiative of the ELA, LAB and CCOO trade unions, the works committee of the Beasaindarra factory sued CAF before the Court No. 1 of Donostia-San Sebastián for refusing to pay the five-year period to the group of graduates, “despite having recognized were stated in the company agreement and charged as such by the group of employees, creating discrimination in payment between groups.
The trial took place on November 17 in the capital Gipuzkoa. At that time, the case filed by the CAF Commission was dismissed, which appealed the verdict to the TSJPV.
The TSJPV has now upheld the appeals of ELA, CCOO and LAB and ordered the CAF company to pay the seniority bonus to the graduates. The verdict can be appealed to the Supreme Court.
From the ELA union, they have encouraged the entire group of CAF graduates to “continue to fight for the demand and realization of their rights, demonstrating with this statement that trade union struggle is the way to improve the working conditions of all workers, regardless of the group they belong to”.
