According to the Munich Administrative Court, the observation of the AfD as a suspected right-wing extremist case by the Bavarian Office for the Protection of the Constitution is legal – a corresponding lawsuit was dismissed.
In a decision published on Monday, the Munich Administrative Court declared that the Office for the Protection of the Constitution’s surveillance of the Bavarian regional association AfD was lawful. Furthermore, the Office for the Protection of the Constitution is allowed to inform the public about this measure.
AfD lawsuit dismissed
The AfD’s lawsuit was dismissed as unfounded because there was a lot of factual evidence that justified this surveillance. The secret service decided to monitor the AfD as a whole party in June 2022 and announced this publicly in September 2022. The administrative court ruled that both surveillance and public information were permitted then and now.
The regional association AfD had filed a lawsuit against the observation and also submitted an urgent application. In April 2023, the administrative court rejected this, and in September the Bavarian administrative court confirmed this decision, Spiegel reports.
The Administrative Court only criticized certain formulations in the press release from the Office for the Protection of the Constitution, which gave the impression that the AfD as a whole was decidedly extremist. The administrative court has now ruled in the main proceedings.
