Not an easy statement for a grandmother from Vienna: during the hostile interrogation, the 59-year-old woman had to describe how she almost became a victim of rape. The perpetrator: Her grandson, only 15 years old at the time of the crime.
“It is an unusual case that is being dealt with today,” the prosecutor opened the attempted rape trial at Vienna Regional Court on Thursday. “Four months ago, a then 15-year-old boy tried to force his maternal grandmother to have oral sex.”
Versions of the crime vary
Before her sits a now 16-year-old teenager who was largely housed in shared apartments and whose social behavior, according to the public prosecutor and expert, was disrupted by numerous traumas in his childhood.
About the crime: The youngster visited his grandmother (59) during the weekend, as he had often done before. On that Saturday in March, he wanted to go out in the evening, but his grandmother forbade him: “I became aggressive, insulted her and wanted to take the key from her in the bedroom,” the boy says in the trial.
From here, the versions diverge. While the grandmother describes the attempted rape credibly in the contradictory interrogation, the defendant has a different version: “My grandmother always hides her keys in her bra or her underwear. That is why he intervened,” he tells the judge. The request for oral sex was only said “out of aggression.”
Instruction is conditional
The jury, however, believes that the grandmother, who had clearly visible hematomas on her arms that night, was suffering from. She screamed for help at the window while her grandson briefly entered the living room. Police took the 15-year-old away and he was remanded in custody until May 28.
The teenager, defended by Iris Augendoppler, accepts the sentence: 15 months in prison, two of which are unconditional. He has already served it in custody. The Senate also issues a briefing. However, the placement of the boy in the prison system will be conditionally granted, with a probation period of three years and under conditions.
