ICJ finds settlements in Palestine illegal and demands Israel repeal laws protecting them

Date:

He has warned Israel that it has “an obligation to fully compensate for the damage caused” since the occupation began in 1967. Netanyahu calls the view “absurd” and appeals to “historical truth”; the Palestinian Authority welcomes the decision.

A new blow to Israel from the International Court of Justice (ICJ), which on Friday deemed Israeli settlements in Palestine illegal and demanded the repeal of “all laws and measures that create or maintain the illegal situation,” as well as “full compensation for the damage caused” and the “evacuation of all settlers,” among other measures.

He highest judicial body of the UN today issued its (non-binding) advisory opinion on a request from the United Nations General Assembly in December 2022 (i.e. prior to the current offensive) on the legal consequences of occupation practices and policies in the Occupied Palestinian Territories, after the International Court of Justice declared itself competent to rule on the matter, against the will of Israel and other allied countries.

The International Court of Justice has found that Israeli settlements and the associated regime in the West Bank and East Jerusalem “have been established and maintained in violation of international law,” and that Israel’s “continued presence” in the Palestinian territories (including the Gaza Strip) is “illegal” and must be ended “as soon as possible,” according to ICJ President Nawaf Salam, who read out the conclusions of a majority of the 15 judges who make up the International Court of Justice.

According to the Court, the Israeli settlement policy is in violation of the Fourth Geneva Convention on the forced displacement of people and, in particular, in relation to the exploitation of the natural resources of the Area, is contrary to international law.

The Court also denounces the “systematic failure” of the Israeli authorities to prevent violence by Israeli settlers against the Palestinian population in the occupied West Bank. The ICJ further states that Gaza is an integral part of the territory occupied by Israel in 1967.and forms a “single territorial entity with the West Bank and East Jerusalem”.

Specific demands of the International Court of Justice on Israel

The International Court of Justice (ICJ) ruled this Friday that Israel “mustrepeal all laws and measures who create or maintain the illegal situation that the settlements, the practices of ‘discrimination’ against the Palestinian people and the attempts to “change the demographic composition from any part of the territory of Palestine.

In addition, it has warned Israel that it obligation to provide a complete repair of damage caused“for their “illegal” actions, including Give the land back and other real estate seized from Palestinian civilians”since the beginning of the occupation in 1967″“.

It also requires the evacuation of all colonists of existing settlements and dismantling of parts of the wall built by Israel who are located in the occupied Palestinian territory, as well as allow that all the Palestinians displaced during the occupation return to their original place of residence“The ICJ has insisted on it.

Netanyahu: ‘The Jewish people are not occupiers of their own land’

The Prime Minister of Israel, Benjamin Netanyahuthe advisory opinion of the International Court of Justice (ICJ) issued this Friday, has been ignored. In his initial reaction to the ruling, Netanyahu described the ruling as: “absurd” and has assured that “the Jewish people cannot be an occupier of their own land, including our eternal capital, Jerusalem, nor of Judea and Samaria, our historic homeland,” referring to the historic Israeli name of the West Bank.

“No absurd opinion in The Hague can deny this historical truth or the legal right of Israelis to live in their own community in our ancestral home,” the president added.

Israeli Foreign Minister Israel Katz responded to Friday’s decision as a “partisan opinion that is completely divorced from reality.”

The Palestinian Authority welcomes the decision

The presidency of the Palestinian Authority has celebrated as a “victory” the ruling of the International Court of Justice (ICJ). The Presidency has indicated that the decision is the dright of the Palestinian people to self-determination, especially after the recent resolution passed by the Israeli parliament rejecting the creation of a Palestinian state.

Similarly, he has indicated that this comes at a time when the Palestinian people of Gaza and the West Bank, as well as East Jerusalem, “are exposed to widespread aggression and genocide,” and therefore “he renews the hope” for a “future free from colonialism”.

Finally, he reiterated the need to end the “policy of impunity” that has allowed Israel to deny the right of the Palestinian people to self-determination “for more than 76 years” and “entrench its policy of apartheid and persecution”.
