The Reiner couple from Raiding have been afraid of rain since 2008 – the water is drained from next door to their property, flooding the basement and causing damage. Despite three opinions, three lawsuits were lost.
The Reiners from Raiding could have had such a good time in the guest house if the neighbors hadn’t built a large biotope with overflow on the slightly higher ground 14 years ago. Since then, during heavy rainfall, the water has overflowed to the Reiners, slowly seeping into the meadow and reappearing in the basement of the house. “We need two to three days before we get the mud out and everything is half dry. And then comes the next rain,” says Bernhard Reiner, who points out the settlement cracks in the foundation and the battered walls during the local inspection “Krone”: “When our son comes to visit, the fungus runs to him!”
Since Reiners’ canal cannot absorb the extra bodies of water, they first tried with well-maintained communications. “I would even have helped the neighbor put a pipe in the sewer,” Reiner says. “But he just laughed at me. And the municipality said the canal infrastructure is okay anyway.” So the only way out was going to court.Three experts declare that the couple was negligent, other expertises should prove poor construction.
The Reiner family was rejected three times and was left with the costs – thousands of euros for the damage, 16,000 euros for the lawyer. “We are powerless,” says Bernhard Reiner.
And what does the neighbor think? “Of course I distract adequately. But the courts need to figure that out – he still has his way through the courts!
