The gender statement on registration forms is now being adjusted – in accordance with a 2018 Constitutional Court ruling. Instead of the mandatory designation ‘man’ or ‘woman’, a total of six designations will be possible in the future, according to a draft by the registration law that was passed in the Council of Ministers on Wednesday.
In June 2018, the Constitutional Court (VfGH) ruled that people whose gender is not clearly male or female have the right to be registered in the Civil Registry (ZRP) and in documents. The cabinet is complying with this decision with the proposed amendment to the Registration Act. In addition to the previous two, the features “diverse”, “inter”, “open” and “no information” should also be available in the future.
More naming options
Another change concerns the ability to specify names. In the future, there will be a separate field for “other names” on the registration form, the certificate of residence and the confirmation of primary residence. According to the explanation in the draft, this is intended to take into account the problem that not all names of persons subject to registration can be clearly separated into first and last names. This should make it possible to include name suffixes (especially middle, patronymic or middle names) that are common outside of Germany in the central population register.
