Climate activist Martha Krumpeck, who is currently serving a substitute prison sentence in Vienna’s police detention center (PAZ) Rossauer Lände, criticized the length of her prison sentence on Wednesday. She criticized “unnecessary hardship” in the form of an “extension of detention,” which she said exceeded the legal maximum of 42 days within a six-month period.
However, the Vienna State Police Directorate pointed out that there was no question of extending the substitute prison sentence.
Detention suspended for funeral
According to a broadcast of ‘Last Generation’ – Krumpeck was part of the management team until November 2023 – the activist was released from substitute detention on Wednesday. However, she interrupted this because of the funeral of her grandmother.
Criticism has now been voiced over the fact that her detention has been extended by another 42 days – and that the earliest her release could take place is September 29. Krumpeck has rejected a fundraising campaign to pay off her fines.
The Vienna State Police Directorate has stated that the interruption of a substitute prison sentence – this is regulated by Article 54a of the Administrative Penal Code – does not result in an extension, but rather in a continuation of the remaining time.
The interruption constitutes a “pause” with respect to the maximum period of six weeks, after which the period starts again – with the said maximum period of six weeks or 42 days, uninterrupted.
A postponement or interruption of at least six months only applies if the punished person has been in prison for six weeks “uninterruptedly” in the preceding six months – which was not the case due to the interruption of detention granted.
