Wanting to make herself important, a teenager marched to the police and claimed she had been raped by an unknown man. For this lie, she was sentenced to 60 hours of community service by the Feldkirch Regional Court.
In contrast to her extremely determined action with the police after the alleged crime, the now 16-year-old student appears rather meek in the trial when prosecutor Karin Dragosits shows her the scope of the blatant lie: “Rape is not a small crime, but a serious accusation of a crime. If you had specifically accused someone of rape, you would be sitting here today for defamation. Furthermore, trumped-up accusations of rape sometimes undermine the credibility of those who are actually victims of such an act.”
Regarding the specific case: At the end of December, the then 15-year-old from Oberland told the police that she had been approached in front of the ice rink in Feldkirch by a man she did not know. After a walk together, she went with him to his nearby apartment. Sitting on the edge of the bed, the stranger began to caress her and then raped her. The student even gives a detailed description of the perpetrator. But she doesn’t know exactly where the alleged tormentor’s apartment is. The investigation begins, but it comes to nothing.
“My client made a mistake”
The suspicion that the girl made the matter up is confirmed. After which the student is questioned again. But the alleged victim remains silent. During the trial, the defense tried to stand up for the liar: “My client made a mistake. Your parents are divorced. She wanted attention. But you have to leave the church in the village: the suspect has just turned 16 and is transitioning from childhood to adulthood. She cannot yet know what the criminal law dimensions are of making a false statement.”
Because the student is insightful and impeccable, the delinquent benefits from distraction in the form of 60 hours of community service. She now has to complete this within six months.
