The National Council has decided on new regulations for the security of mobile phones. In the future, researchers will need the blessing of the judge to assess data carriers such as smartphones. That’s not the only thing new: victim protection is being strengthened. A lawyer from Salzburg explains exactly how to do this.
At the last minute, in mid-December, the National Council voted in favor of the legislative package for the new mobile phone security regime; the Constitutional Court had previously annulled the old arrangement. The most well-known change concerns the confiscation of data storage devices such as laptops and smartphones. In the future, researchers will need court approval to evaluate data. “A Thomas Schmid would no longer be possible with the new law,” says Stefan Rieder, lawyer and head of the Weißer Ring victim protection association in Salzburg.
