Hungarian politicians, lawyers and media sometimes have a different view of things. In the dispute over the traffic barrier in Schattendorf there has already been a triumph over the border.
The discussion about the traffic bollards placed by the municipality of Schattendorf and a specially prescribed pedestrian area at the border is becoming increasingly bizarre. The media in the neighboring country to the east give a false picture. “According to the Burgenland court, the border between Ágfalva and Somfalva should not have been closed to Hungarian commuters. Now the Austrian Constitutional Court is being called on to repeal the Schattendorf Regulation,” it is claimed. “The administrative judge considers the diversion unlawful,” said a news service.
Appeal rejected
“It’s all not true,” goes the saying from Austria. So far, the judiciary has not seen any wrongdoing in the community’s actions. As reported, a Hungarian law firm applied for an exemption to enter the pedestrian zone, but this was rejected. The appeal was dismissed by a higher authority and the contested decision was confirmed.
Zone is located in the municipal area
The motivation states, among other things, that the prescribed pedestrian zone is located entirely in the municipal area, namely ‘in a very sensitive traffic area with a care center, seniors’ home, cemetery, church, kindergarten, hot water bath, extension for the daycare center, primary school and secondary school’. as noted.
According to a letter from the Administrative Court to the Constitutional Court in Vienna, serious accidents have already occurred as a result of speeding towards the border crossing. The pedestrian zone established in accordance with Article 94d, paragraph 8 of the StVO is only in force for one area in Schattendorf, which means that the municipality is responsible for this arrangement, she continued.
Against commuting route
Mayor Thomas Hoffmann sees the decisions of the Austrian court as confirmed. He is strictly against a commuter route. He has no objection to “normal” border traffic between Schattendorf and Agendorf: “In the spirit of a Europe that grows together, we want to maintain good neighbors. Free passage should be available to those who have a significant economic interest or family reasons.”
