A German Muslimin moved to the court in Berlin – she wanted to get an exemption from the heating requirement to be able to drive a car. However, the 33-year-old flashed with her complaint.
According to German traffic traffic instructions, Autodruders are not allowed to cover their face so that they are no longer recognizable. A big problem for Muslimine: Nancy as faith, however, forbids her not to show herself in full veil outside her own four walls.
Wife also wanted to protect herself against strangers in the car
The Muslim, who converted in 2016, therefore wanted to be able to wear a Nikab while driving. With this veil, only the eyes can be seen by a visual crack. It can also be seen in the car by strangers – however, she depends on the vehicle to reach her work in a refugee accommodation or to transport her children.
The plaintiff suggested Nikab with QR code
That is why she wanted to obtain an exemption and brought a lawsuit. The judge said that this was not possible to identify in photos of a radar trap. The plaintiff had a solution for this: she was ready to run a logbook or to wear a Nikab with a visible QR code. In any case, the eye area would be sufficient for identification, she argued. Moreover, motorcyclists with a helmet and identical twins are difficult to recognize or distinguish them, she continued.
Finally, A. failed with her request to the Berlin administrative court. The reason: can only be guaranteed by the prohibition on changing the consequences of legal violations in traffic. The suggestions of A., such as leading a logbook or the Nikab with QR code, are also not suitable.
