Two years before her retirement, Liesinger teacher Judith H. was labeled a refusal to take action and against masks and was fired by the education department – the “Krone” reported. So she appealed. Until the verdicts are handed down, however, she is barred from supply sources, such as social assistance.

In the first of three pending proceedings in the case, H. was right of the administrative court. The ruling states that the Education Directorate must decide on the definitive position of the teacher’s contract. According to her employer, H. was only considered a “provisionally recruited civil servant”, while the teacher, who had worked at Viennese secondary schools for 28 years, appealed. The ruling has consequences for the two ongoing procedures, because in the event of pragmatization, instead of dismissal, a disciplinary procedure would be considered.
The Education Directorate made an extraordinary appeal. So the wait is long for H. Also from the money, because she still does not receive any benefits. But: “I’m not giving in,” she emphasizes.
