The Constitutional Court (VFGH) has rejected a complaint by an Afghan, which must be deported to Greece. He had argued that the basic needs of asian lovers in the Mediterranean were not covered.
The VFGH sees it differently: the supply situation has improved in recent years and the man does not threaten the man. The Afghan had already received asylum in Greece, and therefore his new application in Austria was rejected. On the other hand, he was in court. The federal administrative court already argued that he did not threaten an emergency in the South European country.
Different symptoms of the same time were also rejected as hopeless. In 2010, the Constitutional Court had stopped a transfer of asylum seekers to Greece.

Moreover, the judges at the time decided that the Austrian authorities had to get an individual involvement in childcare to the Greek colleagues. Otherwise there should be no deportation. Germany was sentenced to a fine last fall because a Syrian was deported to Greece.
The new judgment is a “decisive reversal,” said ÖVP Secretary -General Nico Marchetti. “Since interior commissioner Magnus Brunner is responsible for the EU AS lagaders, we see basic improvements in the asylum area throughout Europe. And these improvements at European level have a clear red and white-red manuscript (…).
