After the 62-year-old employee received his termination shortly before Christmas, he turned to AK Vorarlberg. In the consultations, the experts in the field of employment law quickly found there: the employer not only applied the wrong notice period, the termination is also socially illegal. Because according to the law, dismissal in particular can be challenged if employees are particularly seriously influenced by the loss of their work because of their age, long service and imminent unemployment.
“A clear social illegality”
“Older employees in particular who are financially dependent on their work and have no realistic chance of a similar job, have good opportunities to combat such a termination,” explains AK expert in the field of employment law Michael Thurnher. “In this case there are no economic or personal reasons for the termination – a clear social illegality.”
Employer sent in
At the request of the 62-year-old, the AK Vorarlberg contacted the company. After discussions with the legal representative of the company, the employer sent: the termination was withdrawn, the man retains his job and his financial future is secured.
The AK president Bernhard Heinzle van Vorarlberg is still indignant whether the case is indignant: “There is a lack of someone who is about to be a pension and therefore has few prospects for a new job and also in the run-up to Christmas: this is already a really imputable procedure.” Fortunately, the law protects against such unfair practices.
