An upper Austrian did not want to wait for an appointment for the MR examination after worrying about the blood values. She claimed a private performance and received a shock diagnosis. A dispute about the costs followed for the Supreme Court.
Due to poor values of the pancreas after a blood test, an upper Austrian was transferred to an MR examination by her internist. The woman immediately cried at three radiological institutions. There she received the information that no appointment was two to two and a half months free. In her concern, the patient turned to a private institute, where she could conduct the investigation within a few days. For this she paid 360 euros.
An emergency operation followed the investigation
Only a few hours after the MR screening, the radiologist of the Institute called De Vrouw and informed her that surgery was immediately necessary: she was diagnosed with pancreatic cancer.
As a result, the woman tried to repay the costs for the private -MR research and flashed it with the Austrian health insurance fund. But not in court who fully agreed with her. The insurance provider should have provided medical care. The claimant was not offered the proposed period of up to 20 days in cases that are not indicated as “acute” as here in the transfer.
Patient is entitled to reimbursement of the costs
The Health Insurance Fund did not want this – even if it is just a few hundred euros – and brought the case for the Supreme Court. According to the OGH decision, the cash register feared “a general destination for planning and control in health care”.
The Supreme Court is in contradiction: because the insurance sponsor cannot grant the service within the deadline, the woman is entitled to reimbursement of the costs. However, because the transfer was not displayed as an “acute emergency situation”, only for the amount of 128.13 euros.
