Interest on lighting – Street lamps fall for the dishes

A community in Burgenland and its citizens argue about the construction costs for lighting. The decision could have followed nationally.

The whole thing started quite harmless. Like many other communities, Donnerskirchen had switched the lighting to modern LED in a street in 2020 and at the same time renewed the road and seam. In the Zeisel Neuriss area, the lanterns were converted over a length of approximately 250 meters. As usual in such a case, the residents were invoiced part of the costs – the benefits of the residents. For some residents, however, this meant a salted amount of 4000 to more than 7,000 euros. One of the reasons for this was that the unit set for street lighting in Donnerskirchen is 75.75 euros per running meter.

Not all of them had paid
Some of the affected, but not all. Some defended themselves against it and then turned to the constitutional judge (LVWG). The case was long, documents were requested and sent, ordered an expert and recalled, just to order someone else – the years passed.

Eventually an expert opinion came to the opinion that the work had not taken place in a (full) reorganization. The conclusion of this was that there are no costs to write to the residents. This in turn does not want to leave the community on it – and go to the highest authority.

Criticism from Spö
This causes criticism by Spö Councilor Ludwig Fingerhut. “Inexpensively and politically motivated,” the local politician assesses this step. He is on the side of the citizens and is convinced that the administrative court will not get any other knowledge. “Who will pay the procedural costs if the court determines the residents? There may be costs of 10,000 euros or more on Donnerskirchen-en de Spö Council according to an already mashed budget. According to him, the error is a much too high interest rate:” One of the highest in Austria. “

Outtrage only in the case of reorganization
Mayor Johannes Mezgolits of ÖVP, on the other hand, defends the procedure. Because the decision of the state court of the state applies to all communities in the country. Residential services in street lighting can only be compensated if it is a complete RE -Establishment – ie everything has been reduced from cabling to the light body.

According to the knowledge of the court, projects are on hold
Most municipalities can therefore no longer charge residents. Mezgolits therefore wants to assess the matter to create legal security for all municipalities, as he says. “It’s about the fundamental thing.” If the knowledge of the LVWG is confirmed, the municipalities will be back in the future, it will be convinced. Donnerskirchen had already put projects on hold because of the business.

He also defends the unity sets. If these are too low, the supervisory authority does not approve of new loans, which the municipality in turn needs to implement projects.
