In June, Valentina (still 16 years still) will graduate after three years of training at the Vöcklabruck School. Nevertheless, the then trained educational assistant can only start working in crawling and kindergarten a year later, after her 18th birthday.
“You can choose on 16”
The “krone” report on the case caused many discussions online. Most readers shake over the legal regulation – in Upper Austria a minimum age of 18 years applies to working in crèches and the like. “You can choose at the age of 16, drive with 17 cars, but you are not sufficiently responsible for guiding children. What is wrong here?” A reader asks on krone.at. Another noticed: “Completely illogical law!”
Isolated concept of the law
One user suggests: “Then you must place the start of the training in such a way that the applicants are already 18 at the end or will soon be.” Only isolated understanding of the current regulation: “Do you want your children to be guided by young people? We are still talking about people who are still half themselves,” writes a reader.
The minimum age is the state law, but according to the Upper Austria education director, based on the case law of federal courts. In Vorarlberg, however, pedagogical assistant employees can work before their 18th birthday.
