Instead of the usual 400 gram discs, the consumer receives only 300 grammes with Mozart discs: the packaging remains the same, only there is less. Misleading customers, the Vienna Commercial Court now rules.
Too little content and too much air. The Josef Way & Comp. Aktiengesellschaft has fooled its customers with the packaging of its “Mozart Mignon Wafers”. This was decided by the Vienna Commercial Court.
Same packaging, 100g less
Although the bag is the same size and presented in the same way as other products, the Mozart slices contain 100 g less. “Consumers can assume that packaging of the same size also contains the same filling quantity,” says the Consumer Information Association (VKI).
Fill level less than 40%
Similar pieces – “Original Napolitaner” or “Hazelnut Mignon” – are on the shelves in a 400 g bag. “Mozart’s discs therefore have a filling degree of less than 40 percent!”, criticizes the VKI. Even the indication of the filling quantity on the package is not enough to inform the buyer.
The Vienna Commercial Court ruled that the “Manner Mozart Mignon” bag was misleading. The decision is not final!
