After a failed catering career in Thailand, a Vorarlberger wanted to earn his sandwiches with the cultivation and sale of cannabis from an illegal inner system in Switzerland. The thing flew up. The trial at the Feldkirch regional court took place on Tuesday.
It is about growing and passing on the addiction in oversized quantities in the period at the end of 2019 to April 2020. According to public prosecutor Simon Mathis, the suspect would have operated an inner system with 6,000 hemp plants in Switzerland with two legally convicted accomplices. The Vorarlberg is said to have sold about 19 kilos of the considerable harvest of 71 kilograms. Crimes for which the legislative power provides for a maximum of 15 years in prison because of the amount.
Only partially known
That would mean that the 51-year-old had to spend part of his guest house behind Swedish curtains. The defense wants to prevent this. “My client had only performed courier services and had a subordinate role,” explains lawyer Manuela Schipflinger-Klocker to the Schöffensesat. That is why he is only partially dedicated to the crime of addictive trade.
Get an offer like a “hand bag”
He did not operate the inner system in Switzerland. Instead, he came to the whole case by one of the two compliciencies that had already been convicted by law. “After I had to close my two restaurants in Thailand because of Corona, I came back to Europe. I was burned down, so I went to my mother. It was depressing. Then I was given the offer to work as a henchman in the inner system, to carry out painting work and so on,” the Vorarlberger describes the court. The man did not want to know that it was an illegally operated hemp plantation. “I was told that it was a CBD system, but the case must still be kept secret because there is no approval yet.”
A statement that is pissed off in court: “This is so incredible what you tell. I will give you the last time you have the chance to advise yourself with your defense!” But the suspect remains with his version of the naive complicit.
Three and a half years in prison
The evaluation of the crypto -mobile phones used by the defendant at the time proves the opposite. That is why the public prosecutor calls for a guilty judgment within the meaning of the indictment in the “annoying layer”. The apology of the delinquent does not change that. And so the process ends with a smooth guilty verdict and a prison sentence. Means that the Vorarlberger goes from an illegal inner system to a legal. And that is the name for the next three and a half years. In addition, the 51-year-old must pay the expiry date of 106,300 euros to the state. The judgment is not yet final.
