In Bavaria, employees of an open space have found more than 600,000 euros in an apartment – including in diaper packages. The employees also discovered jewelry and coins. However, the company is not entitled to a partial amount or a finder, as the Regional Court of Cologne has now decided.
The clearing company had previously sued a payment of 100,000 euros and a Finder. She referred to a contractual clause that customers have to remove valuable items from the rooms in advance. This also stipulates that all other objects are transferred to ownership of the company with the start of the work.
The Regional Court of Cologne (North Rhine-Westphalia) considered this clause not effective because they have guaranteed them inappropriate. The find does not automatically assume that the customer wanted to leave cash and valuable items worth a few hundred thousand euros. Since the Clearing Company has not found a lost thing, there is also no right to Finder.
The money found is more than 600,000 euros, jewelry and coins have a value of around 30,000 euros. The judgment from the beginning of May is not yet final.
