Unsuspectingly, the young girl met the three men on the evening of June 25, 2021. She knew one of them from Instagram and fleeting meetings – he repeatedly offered her drugs. That evening she decided to take an ecstasy pill and took the three men to an apartment in the 22nd arrondissement.
Choked by an overdose
According to the indictment, the three would have decided at that time to put them under the influence of heavy drugs and rape them together. The prosecutor is sure that the young men violated the willless and defenseless Leonie – they gave her 7 ecstasy tablets beforehand. The girl was unconscious at the mercy of the Afghans. After about an hour and a half, Leonie choked on the overdose. She was found the next day leaning against a tree on a grassy edge.
No murder charge
After a long investigation – initially the number of perpetrators was unclear, one of the men fled, another lied about his age – it was now possible to report the crime. Namely because of rape and serious sexual abuse of minors. But not for murder. According to criminal law, the intention of the act must be taken into account. The men would only have intended to rape Leonie, not to kill her.
Up to life imprisonment
However, the penalty is the same for the offences: the first suspect faces a life sentence, he was 22 years old at the time of the crime, ie fully criminally responsible. The other two were only 18 years old and are therefore considered young adults in criminal law. You risk a prison sentence of 20 years. Lawyer Wolfgang Haas represents one of the suspects in the trial.
According to the indictment, the men’s previous responsibilities are very different from the results of the reports. They don’t want to rape the girl or have sex with her, nor do they want to know about the ecstasy overdose. It is not yet known when the trial will take place.
