Bottleneck in time span – unvaccinated hairdresser visit refused: illegal!

The corona measures of the past lockdowns are being scrutinized – were they constitutional or not? The lockdown for unvaccinated people in the second lockdown was also examined by the Constitutional Court. And then the Constitutional Court ruled that it was illegal to deny unvaccinated people access to the hairdresser for weeks.

The court reaffirmed the admissibility of distinguishing between people with and without 2G evidence and thus the lockdown for unvaccinated per se. However, the Covid-19 Measures Act provided for exceptions that would allow you to leave your own private living space despite the travel restrictions – including “providing the basic necessities of everyday life”.

Focus on duration of disability
According to the Constitutional Court, what this includes also depends on how long the restriction lasts. As a reminder, the regulations were each designed for ten days and were extended several times. And finally, there was an 11-week exit restriction – a lot of time in which the hair grew too.

Because access to the supermarket, bank or pharmacy was granted to unvaccinated people but denied access to the hairdresser – which is exactly what violates the Covid 19 Measures Act, so it is illegal. Due to the travel restriction of one week (eleven weeks as a reminder), the “basic need of ‘daily’ life” takes on a different meaning, which therefore also includes hairdressing visits.

Several rules already destroyed
Not the first pandemic rule to be reversed: According to the VfGH, the corona-related ban on entering cultural institutions in the autumn of 2021 was also illegal, as was the ban on entering sports fields in the first lockdown, as well as the minimum distance between tables in the catering industry and the obligation to provide information to the catering industry Authorities in suspicious cases and the pick-up ban in ski huts during the winter season 2020/2021.
