The government will approve the right to unemployment for domestic workers tomorrow


The new rule will equate the nearly 400,000 affiliates in this sector with the rest of wage earners and end their easy and cheap layoffs

Domestic workers will be able to claim unemployment benefits from January and cannot be fired without valid reason as they are now, allowing them to collect a higher compensation in the event that the employer decides not to use their services. These are two of the rights included in the Royal Decree Act that the Council of Ministers approves this Tuesday to equate this group of workers, the weakest link in the labor market, with the rest of the wage-earners.

This was confirmed on Monday by the President of the Government, Pedro Sánchez, during the meeting he held in the Palacio de La Moncloa with 50 citizens to herald the new political course following a negotiation conducted by the Ministry of Labor since last February. , following the setback caused by the judgment of the Court of Justice of the European Union in which it found discriminatory Spanish law that does not recognize the right to unemployment for this group, which consists almost exclusively of women.

Moreover, it is an old government commitment that comes several years too late and for this the Congress of Deputies last June ratified the Agreement 189 of the International Labor Organization (ILO) that extends the rights of, among other things, the workers of the house , unemployment protection. Similarly, it provides that, like other workers in general, they must enjoy fair working conditions and decent working conditions, as well as a minimum remuneration of the Minimum Interprofessional Salary (SMI), limiting payments in kind, something that is already applied in Spain and supervised on compliance.

The new rule will allow the nearly 400,000 members of the Home Regime to collect unemployment benefits, an old requirement, and furthermore, their dismissal will not be as easy as it has been until now, as redundancy as the cause of the layoff will be abolished. Ministry of Labor sources have confirmed to this newspaper.

Because until now, firing domestic workers has been very easy and cheap. No justification is required. When the employer understands that he no longer needs the services of a housekeeper, he can terminate the contract without explanation. It is only necessary to give her 20 days notice, in case the employee has worked more than a year, or seven days if her seniority is less, and pay her compensation equal to 12 days per year worked, with a limit of six monthly payments.

But when the new standard comes into effect, the dismissal of these workers will be foreseeable on the same terms as the rest of the workers. This means that justification is required and compensation must be paid with 20 days per year worked and a limit of 12 months if it is objective, or 33 days per year worked and up to 24 monthly payments if it is an unfair dismissal.
