Fine of 79 million to Glovo for holding bogus self-employed persons

The inspection forces the company to regularize more than 10,600 workers in Barcelona and Valencia

New millionaire fine for Glovo, adding to a long history plagued by sanctions for circumventing the Spanish norm. The Labor and Social Inspectorate has sanctioned the home delivery company with 78.9 million euros for detaining bogus self-employed people and thereby violating the so-called ‘Rider Law’. This was confirmed on Wednesday by the second vice president and labor minister, Yolanda Díaz, when she arrived at the monitoring session of the Congress of Deputies.

The Labor Inspectorate, which is very vigilant in this type of fraud, finds that more than 10,600 employees who are registered as self-employed with social security are actually employed, as they depend on this company. For this reason, they are forced to regularize them and become part of their staff. Specifically, these are 8,331 Glovo employees in Barcelona and another 2,283 in Valencia, whom the company refused to include on its payroll.

“We are facing an authentic action by false self-employed and the weight of the law will fall on this company, as it has already fallen with the inspection,” warned Vice President Díaz, who accused Glovo of “violating” labor rights. of his employees and “impedes” the work of the inspectors, a fact he described as “very serious” in a social and democratic state, where companies must “comply with the law”.

The so-called ‘Rider Law’, in effect since August 2021, forces digital delivery platforms to hire their delivery drivers as employees. For example, the law recognizes the presumption of employment of employees who offer paid delivery services through companies that manage this work via a digital platform, in accordance with the Supreme Court ruling of September 2020, which determined that the delivery drivers are employed and not self-employed. .
